4Credit Holding B.V. (“CreditClick”) takes your privacy very seriously and treats all your personal information with great care. CreditClick always acts in accordance with the General Data Protection Regulation (“GDPR”). This document sets out CreditClick’s privacy statement for the use of the CreditClick websites (www.creditclick.eu, www.creditclick.nl) and of the CreditClick payment method. 1. Who is CreditClick and how can I contact CreditClick?

CreditClick is a new way of paying for your online purchases. Instead of paying immediately the full amount at purchase or at delivery, CreditClick offers you the possibility to spread the cost over several months.

The party responsible for the processing of personal data is 4Credit IT Services B.V., a fully-owned subsidiary of 4Credit Holding B.V., a private company with limited liability established and existing under the laws of The Netherlands, having its registered office in (1016 AB) Amsterdam, the Netherlands, at Singel 250, registered with the Chamber of Commerce in the Netherlands under 69174431. 2. What personal data does CreditClick process, why and on which legal basis?

Payment Process

CreditClick asks you to create a user account for determining which Credit Supplier should handle your payment requests. You do this by entering your email and your name, and by choosing your country of residence on the welcome page of the CreditClick payment method. CreditClick stores the above mentioned personal data. Next to that, CreditClick receives the purchase amount, and, optionally, your email, your name, and the shipping address from the merchant or their payment service provider.

CreditClick requires this information in order to render its services as optimally as possible (for example, to display content correctly, to keep the website secure, and to pre-populate the input fields and in this way to speed up the checkout), the processing of this personal data is therefore necessary for the purposes of the legitimate interests pursued by CreditClick.

After the creation of the account, CreditClick redirects you to the appropriate Credit Supplier, who collects more data directly from you, following their own process, as described in their privacy statement.

Upon the completion of the process, the Credit Supplier informs CreditClick whether the payment has been accepted, declined, cancelled by user, or abandoned. We do not receive any of your personal data from the Credit Supplier. All personal and financial information entered on the credit application pages, as well as your choice of the credit product is handled directly by your Credit Supplier following their privacy policy and is not shared with us.

Third Party Sources

CreditClick does not collect any personal or other information about you from any other sources.

Contacting CreditClick

If you wish to contact CreditClick with any questions or if you need support with one of CreditClick’s services, you can send us an email to info@creditclick.eu. CreditClick uses your email address and any other information you choose to provide in your email to contact you and respond to your question or message. The processing of this personal data is necessary for the purposes of the legitimate interests pursued by CreditClick, namely being able to serve you efficiently and to optimize CreditClick’s customer service. 

Automatically Generated Data

CreditClick automatically collects generated data about your use of our services. This information consists of your IP address (a unique number, which makes it possible to recognize your device); account activity (including storage usage, number of log-ins); data displayed or clicked-on (including UI elements, links); and other technical information (including browser type, IP address, date and time of access, cookie ID, and referrer URL). CreditClick requires this information in order for the website to work as optimally as possible (for example, to display content correctly and to keep the website secure), the processing of this personal data is therefore necessary for the purposes of the legitimate interests pursued by CreditClick.

 

3. Does CreditClick share my personal data with third parties?

Credit Supplier

In order to facilitate your payment, CreditClick shares your personal data, with your consent, with the Credit Supplier. The Credit Supplier is responsible for granting you the credit.

Automated Decisions

CreditClick does not make any automated decisions with respect to your credit application. All decisions related to the credit are made by the Credit Supplier.

Other Parties

In certain circumstances, CreditClick may share your personal data, with other third parties: 

  • To provide the services, CreditClick shares your personal data with service providers. These service providers process your personal data only on behalf of CreditClick. The processing by service providers is governed by a so called data processing agreement in which CreditClick has ensured that that the service provider shall only process the personal data on instructions of CreditClick.
  • CreditClick will also provide your personal data to third parties if it is obliged to do so on account of national or international laws, case law and/or regulations, if CreditClick considers it necessary to do so in defense of its own rights, if this is necessary for (the improvement of) providing the services/website to you or if you have given permission to do so.
  • CreditClick may transfer your personal data to third parties in the event of a merger, acquisition, reorganization, sales of assets, bankruptcy or insolvency event of CreditClick. If needed by applicable law, CreditClick shall obtain your prior consent. The processing of this personal data is then necessary for the purposes of the legitimate interests pursued by CreditClick.

4. Hyperlinks

The CreditClick websites may contain hyperlinks which take you away from the CreditClick environment and to the website or application of a third party. CreditClick has no authority over the services and/or websites of third parties to which is linked. It therefore may be the case that for the use of those services and/or websites of third parties another privacy statement is applicable. This privacy statement is exclusively applicable to the personal data that is obtained through the website of CreditClick. CreditClick does not accept any responsibility or liability for the (use and/or content of the) services and/or websites of third parties.

 

5. What are my rights?

Under the GDPR, you have a number of rights with regard to your personal data and the processing thereof: 

  • You have the right to obtain confirmation from CreditClick as to whether or not personal data concerning you is being processed, and, where that is the case, access to your personal data and additional information about the processing of your personal data;
  • You have the right to request from CreditClick, the rectification of inaccurate personal data concerning you;
  • In certain cases, you have to right to ask CreditClick to erase your personal data (right to be forgotten);
  • In certain cases, you have the right to obtain from CreditClick a restriction of processing of your personal data, for example when you have contested the accuracy of your personal data;
  • You have the right to receive the personal data which you have provided to CreditClick in a structured, commonly used and machine-readable format and have the right to transmit this data to another controller, where the processing is based on your consent or on a contract (see legal basis);
  • You have the right to object to the processing of personal data which is based on the legitimate interests of CreditClick. CreditClick shall no longer process the personal data unless CreditClick demonstrates compelling legitimate grounds for the processing which override your interests, rights and freedoms or for the establishment, exercise or defense of legal claims;
  • Where personal data is processed for direct marketing purposes, you always have the right to object to the processing of personal data for such marketing. In that case, CreditClick shall no longer process your personal data for such purposes;
  • Where the processing of your personal data is based on your consent, you have the right to withdraw your consent at any time. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

You may send your request to CreditClick at info@creditclick.eu. CreditClick shall respond to your request without undue delay and in any event within one month of receipt of the request. That period may be extended by two further months where necessary, taking into account the complexity and number of the requests. CreditClick shall inform you of any such extension within one month of receipt of the request, together with the reasons for the delay. If CreditClick does not take action on your request, CreditClick shall inform you without delay and at the latest within one month of receipt of the request, of the reasons for not taking action. In this case, you also have the right to lodge a complaint with the supervisory authority and to seek a judicial remedy.

 

6. How does CreditClick protect my personal data?

CreditClick takes appropriate technical and organizational measures to protect your (personal) information against loss or any form of unlawful use.

 

7. How long does CreditClick retain my personal data?

CreditClick shall retain personally identifiable information only as long as reasonably necessary to provide the website and other services to you and others or as otherwise required for legal compliance purposes. If you fill out a contact form on the website, or send us an e-mail, the data that you send to us is stored for as long as is necessary by the nature of the form or the content of your e-mail to be fully answered and handled. For user accounts created and used in the payment process, the CreditClick data retention policy is 7 years.


8. What are cookies and how does CreditClick use them?

When using the website, various cookies are saved on your computer, mobile device and/or tablet (“Devices”), which can then be accessed. Cookies are small pieces of information (in the form of text) that a server sends to the browser (such as Internet Explorer or Firefox) with the intention that the browser sends this information back to the server the next time a user makes use of the website. Cookies cannot damage your Devices or the files saved on it. Please consult the CreditClick Cookie policy for more information about how CreditClick uses cookies. 

 

9. Can this privacy policy be amended?

It is possible for the privacy policy to be amended in the future. It is therefore recommended to regularly visit the section on the website in which we outline the privacy policy. 

 

10. Where can I lodge a complaint?

In case you suspect a breach of data protection legislation and the matter is not solved amicably between you and CreditClick in negotiations, you have the right to lodge a complaint with a supervisory authority.
